Works and other copyrighted material are widely used in the development of technological innovations by using text and data mining techniques, for example, in the training of AI and language models. Under the Copyright Act, copyright holders have the right to prohibit the use of their works and other copyrighted material, such as a book, article or photograph, in commercial text and data mining. In legal terms, this is known as a reservation of rights.
If you do not want your copyrighted material to be used for commercial text and data mining or to train AI, you must explicitly prohibit it in an appropriate way by using machine-readable means. You can include this prohibition either in the general terms of use of the material or in the metadata of the file and website. Please note that text and data mining by research organisations and cultural heritage institutions for the purposes of scientific research cannot be legally prevented by agreements or technical measures.
